I married my wife in Thailand on the 4/3/2011, we had known each other for 8 months and we applied for Tourist visa twice in Bangkok and twice it was refused because the embassy do not believe that my Thai wife will return back to Thailand .
I paid a visa agent in Bangkok 25,000 baht to get us a Tourist visa in 7 days. She guaranteed that my wife will get visa in this time. She didn’t get us the visa and she appealed it again and it was refused again. I came back to Bangkok on the 14th of April 2011, to appeal it for the 3 time, just to get my wife a tourist visa and it was rejected again and they wanted another 25,000 baht.
I visited another visa agent in Bangkok , who said that this visa shouldn’t have been refused twice and that we should have applied for a Spousal Visa to Perth, Australia.
Could you please give me some advice on what to do? It has been very frustrating for me and my wife the last couple of months and my Thai wife is very distressed at this time. I live in Perth, Australia at this time and my wife lives with her children in Bangkok.
Do we need to apply for an Australian Tourist Visa again or a Spousal visa?

Hi John
I am sorry to read that your wife has not been granted a tourist visa.
One of the problems paying a visa company all of the money upfront, is that the importance of getting the visa has been removed. Infact it might be of benefit to get the visa refused as the visa get to charge you again and again.
Our normal advice to any person being refused a visa is not to change the visa that you have applied for.
Better preparation and presentation is required to ensure that the visa will be issued.
Saying that, as you are married, you are in a position to apply for a settlement visa.
My question to you is – What visa do you want, how long would you like you wife to visit you in Australia ?
I would like to talk to you on the phone, or on skype, I would also like to see your last complete visa application and refusal letter.
If we represent you, we only ask for a small deposit and then the balance when the visa has been issued, though if we feel we cannot get the visa, we will not ask for the deposit.
My last bit of advice, do not pay any company the full amount of money upfront. If the company is confident in its ability to help obtain your wife a visa, they should be happy to be paid when the visa has been issued.
I look forward to hearing back from you
Kind regards
Richard
